On September 1st, 2021, a new law (HB 1927) went into effect. People who meet the requirements can now carry a pistol in a public location in Texas without a license (LTC). Texas Penal Code Sections 46.02 and 46.04 define unlawful carry and possession of a handgun.
To carry a handgun in public in Texas without an LTC, a person must meet the following requirements:
- Be at least 21 years old * Not have a past felony conviction as defined in Texas Penal Code Section 46.04.
- Not have a recent misdemeanor conviction as defined in Texas Penal Code Sections 46.02 and 46.04.
- Not be subject to an unexpired protection order as defined in Texas Penal Code Section 46.04(c)
- Not be prohibited from carrying a handgun under federal law as defined in 18 US Code Section 922(g)
- Not be inebriated, except in limited circumstances as defined in Texas Penal Code Section 46.02 (a-6)
Anyone who was forbidden before the new Texas legislation went into effect does not have the right to carry a weapon under the new law.
